Rising Star: Health Law, Law360, 2012

Zuckerman Spaeder LLP is pleased to announce that Law360 has named partner Marcos E. Hasbun to its 2012 list of “Rising Stars,” an awards program honoring attorneys under the age of 40 “whose accomplishments belie their age.” Mr. Hasbun was selected as a Rising Star in the health law category for his success defending high-profile health care clients in False Claims Act litigation.

In its profile of Mr. Hasbun, Law360 recognized his success in several False Claims Act matters, including his representation of Solvay Pharmaceuticals in a case that resulted in an important decision in the U.S. Court of Appeals for the 11th Circuit that clarified the applicability of the False Claims Act in cases grounded in off-label marketing. In addition, Law360 called attention to Mr. Hasbun’s representation of medical device manufacturer Axiom Worldwide in a False Claims Act lawsuit alleging a scheme that caused multiple physicians to submit fraudulent claims for reimbursement to federal health care programs. In dismissing the complaint, the district judge quoted the U.S. Supreme Court’s statement that qui tam suits “are motivated primarily by prospects of monetary reward, rather than public good.”

Mr. Hasbun, who is based in Zuckerman Spaeder’s Tampa office, focuses his practice on white collar criminal matters and complex civil litigation. He has represented pharmaceutical and medical device companies, pharmacies, physicians, and other individuals in the health care industry in federal and state matters involving the False Claims Act, the Anti-Kickback Statute, and in state administrative proceedings relating to alleged regulatory violations. Mr. Hasbun also represents companies and individuals in commercial litigation and international arbitrations conducted under the auspices of the International Chamber of Commerce.

Mr. Hasbun’s legal skills have earned him recognition both in Florida and nationally. He was featured in Florida Trend magazine’s 2011 list of “Florida Legal Elite”—an honor extended to just 2 percent of attorneys in the state, nominated by their peers in the Florida Bar and selected by the magazine. Mr. Hasbun has been listed in The Best Lawyers in America since 2010, while Benchmark Litigation named him a “Future Star” in both its 2010, 2011, and 2012 rankings. Most recently, The Tampa Bay Business Journal selected Mr. Hasbun as an honoree for its 2011 Up & Comers Awards. The annual awards program recognizes accomplished young business leaders in the Tampa Bay area.

Law360 received over 1,000 submissions for its Rising Stars series this year. According to the publication, submissions were carefully reviewed by a team of eight editors. Winners were selected based on the strength of their accomplishments in their respective practice groups thus far in their careers.
